Beyond the Constitution – Law School in 10 Minutes!

We need to simplify the message. So today we’re going to talk about how simple law really is. If people understand law and liberty, everything changes. We must stop getting distracted and divided. We must stand. I could rant on, but the video says what everyone needs to know. Spread it around.

You are describing “The Natural Law” – Legislatures were supposed to create practical positive laws from it to implement it. Aquinas has a section. The Constitution (and Declaration) and the Bill of Rights were the best implementation and expression of the Natural Law since the Magna Charta where the King was subject to the law instead of the law being whatever the King said.

As far as restrictions, I can’t see a reason to enter into a contract that would force me to mow my lawn. If someone else has, unless the contract says he cannot sell the property to anyone who does not sign the contract (which might damage the value and might not be enforceable as a valid provision), that contract cannot be binding to a successor who would be a third party.

To own something is to be able to do what you want with it. We might call it “ownership”, but it is more like a zero-rent lease where you don’t really own it, but can (or can’t) use it in certain ways. The rights (and responsibilities) of property attach to the owners of the property, not to lessees or renters.

Going back to the English common law and traditions (Tom Woods covers it a bit in his recent anarcho-socialism v.s. anarcho-capitalism podcast), you don’t have the right to create a hazard or a nuisance. If my lawn is promoting weeds, is becoming a habitat for noxious insects or animals, etc. my neighbors would have a cause of action against me. In that case I’m violating their property rights because the condition of my property is damaging theirs or interfering with their quiet enjoyment.

One contract, one time, e.g. a deed restriction, is one thing – but note there were racial deed restrictions in my Parent’s deed which were ruled invalid. Even so, who is the damaged party, who is going to sue me if I violate a deed restriction? Only the previous owner should have standing as the contract could only be made with him. What if he is deceased and the estate closed, or he has moved to a foreign country, or is otherwise not going to sue?

You can’t contract to form a government without creating all the problems you already address. If the contract specifies a Home Owner’s Association can make any arbitrary rule, and you must obey, what if the board (oligarchy, not even democracy) decides the subdivision is now a “gun free zone”? You do have an inalienable right to self defense. Restrictions on political signs were invalidated because they violated the first amendment.

Inalienable, fundamental rights cannot be bargained away by contract including the rights regarding property. Personally, I believe all such provisions are null and void. A sale, a transfer of property in exchange when complete should extinguish all rights and responsibilities of the prior owner.

    Lord help you, you uneducated spineless worm. Everything he states is the truth and he is only trying to help people learn their rights. Our Constitutional Rights that my family went to war and gave their lives for people like you and I to have and you want to make a comment like that. Well educate yourself with the NWO because obviously you have no idea what is truly going on in our country today. You sheep being led to slaughter. What hitler did to the Jews is a cake walk compared to what our Government has planned for us. They plan to annihilate 90% of the worlds population. I will pray that your family has someone to protect them when this all takes over because you were too much of a coward and uneducated to learn what is really going on in the world today.
